Furthermore, addressing these aspects not only benefits employees, but also contributes to the success and competitiveness of organisations.

Would you like to find out more about current working conditions and how they have changed over time? Read on!

What are the key aspects of working conditions that need to be addressed?

In the current context, where Quality of life at work is increasingly valued, addressing and improving working conditions becomes crucial to attracting and retaining talent, fostering innovation and promoting a working environment that drives both individual and collective growth.

To achieve this, efforts must be focused on the following areas:

Occupational health: Promoting the physical and mental health of workers is essential. This includes access to medical services, active breaks, workplace ergonomics and comprehensive wellbeing programmes.

Working hours: to establish reasonable and flexible working hours that allow for a work-life balance, as well as respect for rest periods and holidays.

Fair pay: to ensure competitive salaries and benefits commensurate with responsibilities and the labour market, as well as pay equity and transparency in remuneration policies.

Professional development: to provide training, development and skills-building opportunities to support growth and progression within the company.

A positive working environment: to foster an organisational culture that promotes respect, collaboration, effective communication and teamwork.

Work-life balance: to introduce policies that enable employees to balance their work and family responsibilities, such as maternity/paternity leave and flexible working hours, amongst others.

6 Provisions set out in the current regulations governing working conditions in Spain

The regulations set out in the legal framework governing working conditions are varied and are governed by different laws. Below, we summarise the current regulations governing working conditions.

Working day: The law sets a maximum of 40 hours of actual working time per week, with a minimum rest period of 12 hours between working days.¹ Furthermore, after 6 hours of continuous work, a 15-minute break must be taken.

Overtime: These are the hours worked in addition to the normal working day. They are voluntary, unless otherwise agreed in collective agreement, and are compensated through pay or time off during the following four months.

Paid leave: The law provides for paid leave for certain reasons, such as marriage, the death or serious illness of relatives up to the second degree of kinship, a change of residence, and the time necessary to fulfil an unavoidable public or personal duty.

Prevention of occupational hazards: There are specific regulations on occupational health and safety designed to ensure the health and safety of workers.

Remote working: In the wake of the pandemic, regulations were introduced to govern the remote working, striking a balance between the benefits for businesses and workers, and guaranteeing rights such as the voluntary and reversible nature of remote working, equal treatment in terms of working conditions, and maximum working hours and minimum rest periods.

Temperature in the workplace: A Royal Decree-Law has been issued which includes an emergency plan for energy saving and management in the heating, ventilation and air-conditioning of living spaces, including workplaces.

What are the consequences of poor working conditions?

Much has been said about the benefits – for both staff and the company – that good working conditions offer, but what happens when the working environment does not provide the comfort needed to work safely, are employees’ career development expectations not being met, or is there conflict between teams? The consequences can be disastrous, and it is essential to address these issues in good time.

Physical and mental health problems: unsafe working environments, a lack of occupational health measures and high levels of stress can lead to physical and mental health problems among workers, such as injuries, fatigue, anxiety or depression.

Lower productivity and poorer quality of work: poor conditions can affect concentration, the motivation and staff efficiency, which leads to a decline in the quality of the work carried out and in the company’s overall productivity.

Increased absenteeism and staff turnover: employees may be absent more frequently due to work-related illnesses or a negative working environment.

Labour disputes and a hostile working environment: Dissatisfaction arising from poor working conditions can lead to tensions between staff and company management, resulting in a tense, demotivating and uncooperative working environment.

Impact on the company’s reputation: Poor working conditions can damage the company’s image and reputation in the eyes of potential employees, customers and society at large, which may have negative consequences for the organisation’s ability to attract talent and for the public’s perception of it.

We hope we’ve answered any questions you may have had about working conditions and workers’ rights.
