LGTBI protocol in companies: implement best practices

The Law 4/2023 of February 28 represents a legislative milestone in Spain, aimed at promoting real and effective equality for trans people and guaranteeing the rights of the LGTBI community. From the very preamble of this law, it is clear that there is a need to promote public policies that eradicate discrimination and ensure that all people can live their sexual orientation, gender identity, and family diversity with full freedom in Spain.

In this article, we delve into this law and explain its structure, who must implement it, and the importance of having an LGTBI protocol for companies. Let’s get started! 

Law 4/2023 in context

First, you should know that Law 4/2023 is the result of a historical demand by LGTBI associations, which have led the fight for the rights of the collective for decades. The goal is to create an environment of respect, equality, and non-discrimination, taking a step forward toward consolidating a society that values diversity and combats hate and prejudice. 

Regarding its structure, the law is organized into a preliminary title, three main titles, and several provisions, including four additional, two transitional, one repealing, and twenty final provisions.  

Who must implement the LGTBI protocol for companies?

Implementation is not the responsibility of a single person or public actor but rather a shared one. First and foremost, the public authorities play a crucial role in developing measures to recognize, guarantee, protect, and promote equality of treatment and non-discrimination based on sexual orientation, gender identity, gender expression, or sexual characteristics. This includes the promotion of effective equality and the adoption of measures to value diversity, as well as conducting studies and surveys on the situation of LGTBI people.  

Furthermore, according to Article 15 of the law, companies with more than 50 employees were required to develop and implement an equality plan starting from February 2024. This means that companies are responsible for ensuring that their policies and employment practices are aligned with the principles of equality and non-discrimination established by the law.  

As mentioned earlier, the law also establishes the creation of the Council for the Participation of LGTBI People. In this sense, government institutions, private companies, and civil society all play an important role in implementing this law to achieve its goal of real and effective equality

Companies’ obligations to comply with the law

Without a doubt, Law 4/2023 is a fundamental step toward equality. However, beyond words, actions are needed to support and ensure compliance. Therefore, the law sets out several obligations for companies. Below, we detail them.

It may seem obvious, but it is worth emphasizing: the LGTBI protocol for companies is essential. It helps foster an inclusive and respectful work environment that promotes real and effective equality for LGTBI and trans people. This protocol is a key tool to prevent and act against harassment and discrimination, ensuring that all employees, regardless of sexual orientation or gender identity, are valued and treated fairly.  

In addition, it contributes to the company’s social responsibility, improves its public image, and promotes a positive work climate, which can lead to greater productivity and job satisfaction. Ultimately, the LGTBI protocol is a step forward toward diversity and equality, not only within companies but in society as a whole.
